Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Tiny Roots mobile application (the “App”), provided by Tiny Roots (“Tiny Roots”, “we”, “us”, or “our”). By creating an account or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the App.

2. Who Can Use Tiny Roots

  • The App is intended for use by parents and legal guardians who are at least 18 years old (or the age of majority in your jurisdiction).
  • The App is not directed at, and must not be used directly by, children. There is no child-facing account, login, or interface anywhere in the App.
  • By creating a child profile within the App, you represent and warrant that you are that child's parent or legal guardian, or otherwise have the legal authority to provide information about that child to us.
  • You are responsible for the accuracy of the information you provide about yourself and your child.

3. Your Account

You sign in using your phone number and a one-time passcode (OTP). You are responsible for keeping access to your phone number secure, and for all activity that occurs under your account. Notify us immediately at friends@tinyroots.life if you suspect unauthorized use of your account.

4. The AI Parenting Companion — Important Disclaimers

Tiny Roots includes an AI-powered chat companion that offers general parenting suggestions based on the information you share. Please read this section carefully.

  • The AI companion is not a medical, psychological, psychiatric, or emergency service, and its responses are not a substitute for professional advice.
  • For anything involving a possible medical, developmental, or mental-health concern, please consult a qualified pediatrician, therapist, or other licensed professional.
  • If you or your child are in crisis or facing an emergency, contact local emergency services immediately — do not rely on the App.
  • AI-generated responses may occasionally be inaccurate, incomplete, or not applicable to your specific situation. Use your own judgment before acting on any suggestion.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose, or in a way that could harm, endanger, or exploit a child.
  • Upload photos or content that you do not have the right to share, or that depicts anyone other than your own child(ren) without appropriate consent.
  • Attempt to gain unauthorized access to another user's account or to our systems.
  • Reverse-engineer, scrape, or interfere with the App's normal operation.
  • Use the AI companion to generate content that is abusive, exploitative, or otherwise harmful, including content that endangers a child.
  • Impersonate another person or misrepresent your relationship to a child whose information you provide.

We may suspend or terminate accounts that violate this section, and where legally required, we may report content indicating a risk to a child’s safety to appropriate authorities.

6. Your Content

You retain ownership of the photos, memories, and messages you submit to the App (“Your Content”). By submitting Your Content, you grant Tiny Roots a limited license to store, process, and display it back to you as part of operating the App’s features (such as your memory timeline and AI companion). We do not use Your Content to train third-party AI models, and we do not share it publicly.

You are solely responsible for Your Content and for ensuring you have the right to submit it.

7. Subscriptions and Payment

Tiny Roots is currently offered free of charge. If we introduce paid features, subscriptions, or in-app purchases in the future, we will update these Terms and clearly disclose pricing and billing terms before you are charged, consistent with the applicable app store’s (Apple App Store or Google Play) billing and subscription requirements.

8. Intellectual Property

The App, including its design, features, text, graphics, and underlying software, is owned by Tiny Roots and protected by intellectual property laws. Except for Your Content, nothing in these Terms grants you any right to use our trademarks, branding, or proprietary technology.

9. Termination

You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. Sections that by their nature should survive termination (including Sections 4, 6, 10, 11, and 12) will continue to apply.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY GUIDANCE PROVIDED BY THE AI COMPANION WILL BE ACCURATE OR SUITABLE FOR YOUR SITUATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY ROOTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT PROVIDED THROUGH IT, INCLUDING GUIDANCE FROM THE AI COMPANION. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold Tiny Roots harmless from any claims, damages, or expenses arising from your use of the App, Your Content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the courts of India. If you are located in the United States or another jurisdiction, applicable local consumer protection laws that cannot be waived under your local law will continue to apply to the extent required.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the App or by other reasonable means before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
